The police were called to our client’s house on a report of a fire. In securing the home, firefighters located a firearm and turned it over to the police. The police then seized the firearm and refused to return it to our client despite the fact that it was lawfully owned by him. Approximately two weeks later, the police returned and seized a second firearm and ammunition. The police then also refused to return the second firearm but did return the ammunition. The client filed suit in U.S. District Court alleging violations of his constitutional rights under 42 U.S.C. Section 1983. After litigating the case over a period of several months, the city agreed to settle the case for $32,500.
