Felony Drug Charge Dismissed Following Unlawful Traffic Stop in Hennepin County

Felony Drug Charge Dismissed Following Unlawful Traffic Stop in Hennepin County

Our client’s vehicle was followed by the police for several blocks in North Minneapolis. The police stopped the client’s car for allegedly going through a red light and for not having working lights over the rear license plate. Following the stop, the officers searched the vehicle and seized approximately 423 grams of suspected marijuana. Our attorneys filed motions challenging the lawfulness of the stop and to dismiss the case for lack of probable cause. After a hearing involving testimony by the officers and our client, the district court judge agreed with our position that the stop of the vehicle was made without a reasonable articulable suspicion of criminal activity and without probable cause. The judge then suppressed all evidence stemming from the unlawful traffic stop, and dismissed the case.
