Minnesota’s drug crimes are codified in Chapter 152 and are formally named “controlled substance crimes.”
The most common offenses are ranked from fifth to first degree. Fifth degree offenses are the least severe and are either gross misdemeanors or low-level felonies depending on the quantity of the controlled substance and the person’s criminal history. Most fifth degree convictions are presumptive probationary offenses under the Minnesota Sentencing Guidelines.
At the other end of the spectrum, first degree convictions can carry up to 40 years in prison and are presumptive prison commitments.
In the middle of those two extremes, are offenses like second degree drug crimes. These offenses are highly nuanced and their consequences vary significantly depending on the particular facts of the case and the person’s criminal history.
