Underage Drinking and Driving and Other Charges Dismissed

Our client was charged with multiple offenses in Hennepin County after he was stopped on Interstate 494 in the City of Bloomington.  These charges included DWI, underage drinking and driving, open cannabis package, minor consumption, and careless driving.  The client was stopped for allegedly violating Minnesota’s Move Over Law, which requires drivers to move over when they see a stopped emergency vehicle on the highway.  However, in this instance, the police vehicle was driving down the shoulder, and was not stopped.  We challenged the legality of the stop of our client’s car by filing a motion to suppress evidence and dismiss the charges, and we also sent the prosecutor a letter requesting dismissal.  Eventually, the prosecution decided to dismiss the case.  All charges were dismissed, and the case was closed.
