Client Receives Stay of Adjudication in First Degree Criminal Sexual Conduct Case in Kittson County

The client was accused of committing two counts of criminal sexual conduct in the first degree and two counts of criminal sexual conduct in the second degree for acts alleged to have occurred in a rural area in Kittson County. The client was facing a minimum presumptive prison term of 144 months in state prison if convicted. The case was very complex and charged with emotions. After nearly two years of hard fought litigation (and many overnight stays in nearby Thief River Falls), Adam was able to secure a settlement for the client whereby the client entered Alford pleas to the two counts of criminal sexual conduct in the second degree. The client received stays of adjudication on both counts, which meant that if the client successfully completed probation, he would not have a conviction for any crime. Additionally, the Alford pleas allowed the client to maintain his innocence. By having adjudication stayed, the client was also able to avoid the requirement of registering as a predatory offender.
