Domestic Assault

Domestic assault is different from regular assault in that it involves an assault against a “family or household member”. Family or household members include but are not limited to spouses and former spouses, children, parents, persons related by blood, persons who are residing together or who have resided together in the past, and person involved in a significant romantic or sexual relationship. A person who does any of the following to a family or household member may be charged with this offense:
- Commits an act with intent to cause fear in another of immediate bodily harm or death; or
- Intentionally inflicts or attempts to inflict bodily harm upon another.
A first offense of domestic assault is typically charged as a misdemeanor. The charges may be enhanced to a gross misdemeanor or felony depending on prior convictions or other circumstances. A felony offense is punishable by up to five years imprisonment, a $10,000 fine, or both. Additionally, Minnesota statutes create mandatory minimum sentences for aggravated violations of domestic assault in certain circumstances.
The immediate collateral consequences stemming from a domestic assault allegation in Minnesota can be many. These may include the filing of a domestic abuse no contact order (DANCO), an order for protection (OFP), a county human services, investigation, firearms restrictions, and divorce proceedings.
