Fair Credit Reporting Act (FCRA) 
The federal Fair Credit Reporting Act (FCRA) is a wide-reaching law aimed at governing the accuracy and confidentiality of information in consumer reports. But just what are consumer reports? Under the FCRA, consumer reports are defined as “any written, oral, or other communication of any information by a consumer reporting agency bearing on a consumer’s credit worthiness, credit standing, credit capacity, character, general reputation, personal characteristics, or mode of living which is used or expected to be used or collected in whole or in part for the purpose of serving as a factor in establishing the consumer’s eligibility” for credit,employment, or insurance purposes. Under the FCRA, employment background checks are considered “consumer reports.” This is because the FCRA is not limited to credit reports, but extends to criminal background checks and reports, personal or professional reference checks, and other information obtained by a reporting agency and provided to potential employers.
