The Second Amendment to the United States Constitution is an important, fundamental right enjoyed by law-abiding American citizens. It is often said that it is so important the Framers of the Constitution intentionally placed it right after the free speech and free exercise rights contained in the First Amendment.  There is no doubt that gun rights are among the most important rights enshrined in our Constitution.

FIREARM SEIZURES

At Lundgren & Johnson, we know how important the right to bear arms is to our fellow Minnesotans. We also understand from history and our professional experience that the police are often quick to seize and attempt to forfeit firearms from law-abiding people. PERMITS TO CARRY/PURCHASE

Our firm also focuses on the rights of Minnesotans to keep and bear arms in public. Minnesota is a gun-friendly state. Since 2003, state law has permitted eligible Minnesotans to carry firearms in public so long as they have obtained a permit to do so (this is often called a “conceal carry” permit even though there is no requirement that one’s firearm be “concealed”.).

The Minnesota Legislature has specifically declared at Minnesota Statute 624.711 that it “is not the intent of the legislature… to confiscate or otherwise restrict the use of pistols or semiautomatic military-style assault weapons by law-abiding citizens.” In reality, local police departments and sheriff’s departments do not always share the vision of our state law. This means that you may be denied a permit to purchase a firearm or be denied a permit to carry a firearm erroneously. If you believe you fall into either of these categories, the law may be on your side.
