UNAUTHORIZED ACCESS
Minnesota Statute Section 609.81 criminalizes the unauthorized penetration of a computer security system. The penalties range from a misdemeanor to felony depending on the level of harm to public safety, health or to an individual in particular.
ENCRYPTION/CRIMINAL FACILITATION
Minnesota Statute Section 609.8912 criminalizes the use of encryption to aid, facilitate, or conceal a crime. It further criminalizes the unauthorized use of encryption to hinder or prevent another’s lawful use of their computer. The penalties range from gross misdemeanor to felony depending on the specific circumstances.
