Conviction Reversed for Insufficient Evidence at Minnesota Court of Appeals

hunting crimeThe client was convicted at trial in northern Minnesota of possessing a firearm in a state game refuge.  The client then hired our firm to appeal his conviction to the Minnesota Court of Appeals.  Dave thoroughly and effectively researched the facts, the law, and prepared a 36-page legal brief that was filed in the Minnesota Court of Appeals.  After oral argument, the Court of Appeals released an opinion reversing the client’s conviction for insufficient evidence.  The Court of Appeals unanimously agreed with Dave’s primary appellate argument that the State did not prove beyond a reasonable doubt that a state game refuge existed at the area in question.  Because there was not sufficient proof of a game refuge, the evidence was insufficient to support the client’s conviction for possessing a firearm in a game refuge.
