Felon in Possession Charge Dismissed in Hennepin County

Our client’s vehicle was followed by the police late at night in the City of Richfield. The police stopped the client’s car for allegedly committing several traffic violations and driving suspiciously. Following the stop, the officers searched the vehicle and seized drugs and a pistol.  Because our client was a convicted felon, he was charged with the felony offense of felon in possession of a firearm.  If convicted, the client was facing a mandatory minimum sentence of 60 months imprisonment. Our attorneys filed motions challenging the lawfulness of the stop and to dismiss the case for lack of probable cause. After a hearing involving testimony by the officer and several photographic exhibits offered by the defense, the district court judge agreed with our position that the stop of the vehicle was made without a reasonable articulable suspicion of criminal activity and without probable cause. The judge then suppressed all evidence stemming from the unlawful traffic stop, and dismissed the case.
