Felony Drug Charges Dismissed Due to Unlawful Search in McLeod County

The client’s home was searched by the police after her back door was inadvertently left open. A substance alleged to be Methamphetamine was discovered and she was charged with First Degree Possession of a Controlled Substance – the most serious drug charge in Minnesota. Charges were reduced to Fifth Degree Possession of a Controlled Substance after the County Attorney acquiesced to a motion to dismiss for lack of probable cause for the First Degree charge. Then, an evidentiary hearing was held on David’s demand where he established the illegal nature of the police officers’ actions in searching her home. All evidence was suppressed and the entire case was dismissed for lack of probable cause.
