Gross Misdemeanor DWI Test Refusal and Under the Influence Charges Dismissed in Case with .19 PBT

Our client was charged with one count of gross misdemeanor DWI – Test Refusal, one count of misdemeanor DWI – Under the Influence, and one count of Carrying a Pistol Under the Influence of Alcohol.  After reviewing all relevant discovery and engaging the prosecution in numerous plea discussions, the client was permitted to enter a plea of guilty to an amended count of Careless Driving, with the gross misdemeanor and misdemeanor DWI counts dismissed.  As for the Carrying a Pistol Under the Influence of Alcohol count, the client received a stay of adjudication, which means that so long as the client does not violate his one year of unsupervised probation, that charge will be dismissed.  In the end, the client will walk away from the case with only a conviction for careless driving.
