David Lundgren’s client was accused of second degree criminal sexual conduct in several cases, with several alleged victims.  If convicted, Mr. Lundgren’s client faced multiple decades in prison, lifetime predatory offender registration, and lifetime conditional release.  The alleged victims were family members, and the allegations were serious sex crimes.

Mr. Lundgren approached the case in the same manner that he approaches all of his cases.  He kept an open mind, while taking swift action to review the evidence and uncover additional favorable evidence.  Through this process, it became clear that all of the alleged victims had an intense bias against his client unrelated to the accusations.  Additionally, they all had something substantial to gain by raising the sex crimes allegations against him.

Mr. Lundgren prepared the cases for trial and was ready to explain to the jury why the alleged victims’ claims were unbelievable.  Shortly before trial, the prosecutor offered Mr. Lundgren’s client a plea to a misdemeanor assault, unrelated to criminal sexual conduct.  Mr. Lundgren’s client walked away from the matters with two misdemeanor convictions and no jail.
