Minnesota Theft Laws
In Minnesota, theft is broadly defined as intentionally taking, using, concealing, or transferring property belonging to another person without consent and with the intent to permanently deprive the owner of the property. The law covers a wide range of conduct beyond traditional stealing. Our attorneys have experience in defending against a wide range of theft cases in the Minneapolis/St. Paul metro area and beyond. These cases range from misdemeanor shoplifting to complex white collar fraud cases in state and federal court.
Types of Theft Charges
Shoplifting and Retail Theft
Retail theft, commonly referred to as shoplifting, is one of the most common criminal charges in Minnesota. Retailers frequently rely on loss prevention officers, surveillance cameras, and inventory tracking systems to identify suspected shoplifting incidents. Even when the value of the merchandise is relatively low, prosecutors may still pursue criminal charges.
Theft by Swindle
Theft by swindle occurs when someone allegedly obtains property or money through deception or fraudulent representations. These cases often involve financial transactions or alleged scams. Because swindle cases often involve financial records and digital evidence, they can be complex and require careful legal review.
Employment Theft and Embezzlement
Employee theft cases involve allegations that an employee took money, merchandise, or other property from their employer. Employers may conduct internal investigations before contacting law enforcement, and these investigations sometimes lead to criminal charges.
Financial Transaction Card Fraud
Using someone else’s credit card or financial information without authorization can result in theft or fraud charges under Minnesota law. Because these investigations often involve digital records and bank transactions, prosecutors may rely heavily on financial documentation and electronic evidence.
Receiving Stolen Property
A person may also face theft charges if they are accused of possessing property that they knew—or reasonably should have known—was stolen. In some cases, individuals are unaware that property they purchased or received was stolen, which can become an important issue in the defense of the case.

Representative Theft Case Results
Below are several examples of outcomes our firm has achieved in theft-related cases. While past results cannot guarantee similar outcomes in future cases, they do demonstrate the dedication, preparation, and seriousness we bring to every theft case we take on.
Theft by Swindle Charges Dismissed
Our client was charged with theft by swindle following allegations that he stole from his employer. Prior to the second pretrial hearing, the prosecution dismissed the case.
Charges Dismissed in Ramsey County Theft Case
Our client was charged with misdemeanor theft. At the first court appearance, Adam was able to convince the prosecutor to dismiss the charge outright.
Diversion for Client in Felony Auto Theft Case
Our client was charged in Hennepin County with felony theft of a motor vehicle. At the second court appearance, the prosecutor agreed to resolve the case by diversion. After one year, the case was dismissed.
Charges Declined After Federal Theft Investigation
Our client was investigated by the federal Department of Labor following allegations that he embezzled over $34,000 froma local union of which he was an active member. We conducted a thorough investigation and hired a private investigator to interview witnesses that the government did not interview. Based on this work, the client was never charged.
Client Avoids Prosecution in Felony Fraud Case
Our client was investigated in Hennepin County for engaging in a fraudulent scheme to obtain state assistance by misrepresentation. Search warrants were executed on his home, and files and computers were seized, along with the client’s firearms. The investigation lasted over two years, during which time we performed an independent investigation into the facts and allegations. Ultimately, the Hennepin County Attorney’s Office declined to prosecute the client and all of his property was returned to him.
Theft Charges Continued for Dismissal
Our client was accused of stealing from a Kohl’s in Bloomington. She was not a citizen and was concerned about the consequences of a conviction. A continuance for dismissal was bargained for by our firm on the client’s behalf. The case was dismissed after a year.
Frequently Asked Questions About Minnesota Theft Cases
Can I be charged with retail theft even if I never leave the store?
The answer is maybe. The most common dividing line is whether a person has passed by all of the final “points of sale.” For example, if a person walks passed the checkout and is leaving the store, they may be charged with theft for any unpaid merchandise.
If I return the property to its owner, will the charges be dropped?
Probably not. It is best to consult with an experienced criminal defense attorney before attempting any kind of self-help during the pendency of your criminal case.
Can a first time theft charge be dismissed?
Yes. While there are many factors that may impact this decision, it is possible for you to have a theft charge dismissed either by the prosecutor or the judge. Strong advocacy by a criminal defense lawyer who regularly handles theft cases is key.
How long does a theft case take in Minnesota?
The timeline for a theft case can vary depending on the complexity of the case and other factors. Some cases may be resolved within a few months, while others may take longer if the case proceeds to trial or involves extensive investigation.
Should I talk to the police if I am arrested?
If you are arrested, or if law enforcement contacts you about a theft investigation, it is usually best to speak with an attorney before answering questions. Statements made to police can be used as evidence in court. Consulting with a defense lawyer before speaking with investigators can help ensure that your rights are protected.
Do you represent clients outside Minneapolis?
Yes. Our firm represents people charged with theft throughout Minneapolis, St. Paul, the Twin Cities metro, and Greater Minnesota. We have extensive experience in theft cases in the Twin Cities and beyond.
